Please read these terms and conditions on this page before you make a booking.

General Release/Indemnity/Hold Harmless:
You, The Customer will take all necessary precautions regarding the items rented/equipment, and protect all persons and property from injury or damage. The customer acknowledges that they are in charge of the operation and are fully responsible for its safe operation. Customer acknowledges and agrees that Twisted Foam, LLC is not responsible for any injury occurring to the Customer, or any guest of Customer, or to any other person at the event. I, the customer, agree to indemnify and hold harmless Twisted Foam, LLC against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation, or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs. I, the Customer, on behalf of myself, my child(ren) and guest, acknowledge and understand the potential risks associated with participating in a foam party, or any of the activities involved with Foam Machines, including, but not limited to, physical injury from falling, slipping, crashing, or colliding, skin irritation, emotional injury, paralysis, distress, damage, or death to any participant. I understand that despite safety precautions taken by the event organizers and equipment providers, accidents and injuries can occur. Other risks include, but are not limited to, slips, falls, contact with other participants, negligent or wanton acts of other participants, any defects or condition of premises or equipment, insects or wild animals, the effects of the weather including high heat, cold temperatures, storms, and/or humidity. Individuals who are pregnant, have a heart condition, or have previous athletic injuries that may increase vulnerability to injury, should not engage in the Activities.
Inclusion Policy:
Twisted Foam, LLC does not and shall not discriminate on the basis of race, color, religion (creed), gender, gender expression, age, national origin (ancestry), disability, marital status, sexual orientation, or military status, in any of its activities or operations. These activities include, but are not limited to, hiring and firing of staff, selection of volunteers and vendors, and provision of services. We are committed to providing an inclusive and welcoming environment for all members of our staff, clients, volunteers, subcontractors, vendors, and clients.
Supervised Children:
Twisted Foam, LLC does always require a parent or responsible adult to be present at and in visual contact of any Twisted Foam Party event. The parent or responsible adult must at all times provide supervision of the event. This supervision requires focused attention and intentional observation of children at all times. In the event supervision is not provided, Twisted Foam, LLC will end the service and depart the location without opportunity for any sort of refund.
Access to Water and Electricity:
We will require access to both water and electricity for your event. A standard outside water faucet and 3-pronged electrical outlet will be required within 50‘ of any event. Please let us know in advance if this is an issue or with any questions. Please note if we arrive and do not have access, we will not be able to set up the equipment and you will still be responsible for the full cost of the scheduled event.
Payment Policy:
All payments for events will be due and collected by Twisted Foam Party on the day of your event, but prior to the set up of the equipment. We accept all major debit and credit cards.
Refund Policy:
All sales are final. No refund will be given for any reason.
Deposit Policy:
The NON-REFUNDABLE deposit is $75 to reserve your date and is due at the time of booking.
Bad Weather:
In the event of severe weather (lightning, very high winds, flooding and/or rain) we may (and reserve the right to) reschedule your service to guarantee the safety of you, your guests, our staff, and equipment. If the threat of these storms threatens your party and you are aware in advance (pending or anticipated major storm or another strong weather event) please contact us to begin the rescheduling.
The non-refundable deposit will ONLY be refunded if canceled due to weather conditions. If you reschedule, the deposit can be moved to a new date.
Photography and Video Release:
While your event is in effect, Twisted Foam Party may be taking pictures of the party, guest, the event space, and any other involved area. We may use these on our social media page or our website or any other marketing and promotion purposes. If you do not want us taking these pictures, please notify Twisted Foam Party prior to the start of the event.
Privacy Policy:
Twisted Foam, LLC is committed to protecting your privacy. We use the information we collect on the site to make bookings as simple as possible and to enhance your overall experience. We do not sell, trade, or rent your personal information to others. We do not store any payment information in our systems and use well-established payment processors for payment processing to ensure safe transactions.
Alcohol/Drugs:
You may serve alcohol at your event or party; however, we reserve the right to refuse, cancel or cut short any party or booking when alcohol is being served if we, at our discretion, deem the safety of our staff, equipment or participants is compromised in any way. Drugs of any sort will not be tolerated in or around the foam party area, Twisted Foam Party, or our equipment. Any observed use of illegal narcotics or legal narcotics used in an illegal manner may result in the termination of the party immediately.
I understand that consumption of alcohol or drugs before or during the Activity increases risk to myself and others, and I agree to not participate while under the influence of any intoxicating substances, even if legally prescribed.
Damage/Injury:
Colored / UV Foam may stain if not washed thoroughly within 24 hours. Grass, cement and asphalt are usually fine but porous flooring like some tile may leave a stain. Please consider the area you want the colored / UV foam to be blown on before booking your party. We are not responsible for any damages due to the negligence of the party host and party attendees.
Neither Twisted Foam, LLC nor any of its employees shall be responsible for any damage to property. This includes both above-ground and below-ground property/equipment damage including but not limited to grass, plants, animals, buildings, trees, pools, furniture, or any other property. Additionally, we reserve the right to charge the client for damages to the equipment resulting from the careless or willful damage by clients or guests. Neither The Foam Team nor its employees assume any responsibility for any injuries sustained on the client’s property or their designated location. All liability for damages or injuries are the sole responsibility of the client and/or host.
